1. INTRODUCTION
This website is operated by Elora Boutique (“Elora Boutique”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website and any purchase you make through it.
By using the website and/or placing an order, you agree to these Terms and our Privacy Policy (and any other policies posted on the website, including our Return Policy). If you do not agree, do not use the website.
Canada-only sales. Fenaro offers products for purchase by customers located in Canada. You are responsible for ensuring that your purchase and use of the products complies with any laws applicable to you.
2. ELIGIBILITY & ACCOUNT
You confirm that you are the age of majority in your province/territory of residence, or that you have the authority to enter into these Terms.
You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. OUR ROLE / THIRD-PARTY FULFILLMENT
Fenaro sells products via this website. We do not manufacture the products we sell. Orders may be fulfilled and shipped by third-party suppliers and logistics partners (including suppliers located outside Canada). As a result:
- items may ship separately,
- packaging and inserts may differ from standard retail packaging,
- product labels/instructions may be in another language,
- minor variations in colour, finish, sizing or components may occur.
We remain your point of contact for customer service and returns as set out in our policies, but fulfillment and shipping operations may be performed by third parties.
4. PRODUCT INFORMATION & AVAILABILITY
We try to display product information accurately. However, product images, colours and measurements may vary depending on your device and manufacturing tolerances.
We may correct errors, update product information, or change availability at any time. We may limit quantities and refuse orders at our discretion.
5. PRICING, TAXES, DUTIES & IMPORT FEES
Prices are shown in CAD unless otherwise stated.
Unless explicitly stated, prices exclude:
- Canadian sales taxes (GST/HST/PST/QST),
- customs duties, import taxes, brokerage fees, clearance fees, and other charges that may be assessed by Canadian authorities.
You are responsible for any such charges and for complying with import requirements. We may update pricing and promotions at any time.
6. ORDER FORMATION, ACCEPTANCE & CANCELLATION
Placing an order constitutes an offer to purchase. We may accept or reject your order. A contract is formed only when:
- payment is successfully processed, and
- we issue an order confirmation (or ship/dispatch confirmation).
We may cancel/refuse orders due to product unavailability, pricing/description errors, suspected fraud/abuse, payment issues, or other legitimate reasons. If we cancel after payment, we will refund the amount paid for the cancelled portion.
7. PAYMENT
You represent that you are authorized to use the payment method provided and that payment information is accurate. If payment fails or is reversed/charged back, we may cancel the order and/or suspend service.
8. SHIPPING, DELIVERY & RISK
Shipping times are estimates only and not guarantees. Delays may occur due to carriers, weather, customs, peak periods, or other circumstances beyond our control.
Risk of loss passes to you upon delivery to the shipping address you provided (as confirmed by carrier tracking or delivery confirmation). If a parcel is returned due to an incorrect/incomplete address, you may be responsible for additional shipping costs.
9. RETURNS & REFUNDS
Returns and refunds are governed solely by our Return Policy, which forms part of these Terms. Unless our Return Policy states otherwise:
- return shipping costs are your responsibility,
- items must be returned in original condition (unused/unworn where applicable) with original packaging/tags.
We may refuse returns that do not meet the Return Policy conditions.
10. DISCLAIMERS (NO MEDICAL/PROFESSIONAL ADVICE)
Any information on this website is provided for general informational purposes only and is not professional advice. You are responsible for determining product suitability for your needs.
11. WARRANTY DISCLAIMER
To the maximum extent permitted by applicable law, the website, services and products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties/conditions of merchantability, fitness for a particular purpose, durability, title and non-infringement.
Important: Some provinces/territories do not allow limitations on certain implied warranties/conditions for consumers. In such cases, those limitations do not apply to you.
12. LIMITATION OF LIABILITY (INCLUDING PRODUCT-RELATED CLAIMS)
To the maximum extent permitted by applicable law, Fenaro will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, goodwill, data, or business interruption, arising out of or relating to:
- your use of the website,
- products purchased through the website,
- shipping delays, customs actions, carrier issues, or third-party fulfillment issues.
Cap on liability: To the maximum extent permitted by law, Fenaro’s total liability for any claim arising out of or relating to an order is limited to the amount you paid to Fenaro for the product(s) giving rise to the claim.
Non-excludable rights: Nothing in these Terms excludes or limits liability or consumer rights where such exclusion/limitation is not permitted by law (including rights under applicable provincial consumer protection laws).
13. INDEMNITY
You agree to indemnify and hold harmless Fenaro from claims arising out of your breach of these Terms, misuse of the website, violation of law, or infringement of third-party rights.
14. INTELLECTUAL PROPERTY
All website content (text, images, design, logos, graphics) is owned by Fenaro or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or exploit content without prior written permission.
15. THIRD-PARTY TOOLS & LINKS
We may provide access to third-party tools and links. We are not responsible for third-party content, availability, or practices. Use them at your own risk.
16. USER CONTENT (REVIEWS/FEEDBACK)
If you submit reviews or feedback, you grant Fenaro a worldwide, royalty-free, perpetual licence to use, reproduce, modify and publish it for business purposes. You confirm your content is lawful, accurate, and non-infringing.
17. PROHIBITED USE
You must not use the website for unlawful purposes, to distribute malware, to scrape/crawl, to interfere with security, or to harass/mislead others. We may suspend or terminate access for violations.
18. PRIVACY
Your personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA where applicable.
19. CHANGES TO TERMS
We may update these Terms at any time. Changes take effect when posted. Your continued use after changes constitutes acceptance.
20. GOVERNING LAW & DISPUTES (CANADA-ORIENTED, PROVINCE-SAFE)
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, except that mandatory consumer protection laws of your province/territory of residence may apply and will not be displaced.
